How do I add my wife's name to the house that I own?

Posted on: 07th Feb, 2007 06:50 pm
I own our home 100% but both our names are on the mortgage. I need to add my wife's name to the house deed so both names will be on the deed in case something happens to myself...how do I go about adding the wife's name on the house deed?
hi doubleplay,

welcome to forums.

you can add you wife's name on the title by a quit claim deed. contact an attorney who can draft the deed for you as per the terms and conditions which you like to apply. then get the deed signed by a notary public and get it recorded at the county recorder's office.

thanks,
james.

I agree with Jameshogg, quit claim deed is one of the simplest ways of adding a person to the title of the property. You as the grantor would be able to transfer any percentage share of the home in your wife's name. She will be named as grantee in the deed.

In the deed it could be mentioned that you two will hold title as joint tenants with rights of survivorship. As you are concerned about your wife's legal rights over the house if something happens to you.

If the title is held as joint tenants with rights of survivorship then if a joint tenant dies, his interest in the property automatically transfers to the other persons named as joint tenants. And it will not be necessary to make a will to transfer the property.
