divorce quit claim deed

Posted on: 14th Mar, 2007 04:56 am
i was divorced almost two years ago and i signed a quit claim deed to give my ex-husband full ownership of the home. i recently filed chapter 13 and found out that my divorce attorney never filed the deed. i don't know what to do to get my name off this home. i paid my attorney to file the deed and he did not so help!!!!
I think you should contact the office of your County Recorder and enquire about the time period during which the deed should be filed to make it valid.

well mac, i am not sure whether this is going to work out because the deed is signed two years ago.

mboyd, no need to panic. since you have filed chapter 13 bankruptcy, there is less chance of your losing the home. this is because you will be making the debt payments using a payment plan approved by the court and your bankruptcy trustee.

Mboyd,
" I recently filed chapter 13 and found out that my divorce attorney never filed the deed. I don't know what to do to get my name off this home."
Consult an attorney to know if the deed is still valid and if it is then it can be recorded now. After it is recorded the house ownership will get transferred in your ex-husband's name.
