heir property

My grandmother passway she left her house as heir property. She had 11 children. 2 of them passway my uncle and my mother which is the oldest of them all. My mother has 4 children are they intitled to any thing, if the house is rented or sold.

One of my aunt has been paying the tax, and insurance. now they coming together typing a letter with 9 children names to help pay the taxes and insurance but are not including my mother children because she no longer here, Can they do that.
My father allowed her sister to live in his share without any deal. Its is grand pa property whether my father mother can sell it or not i am her grand son now i am major only.Its possible that i can ask for my grand pa land for me and can i chase my aunt legally or i want to ask leagally the land is under whose control what are the steps to find out how the land comethon and how can i know with out my aunt knowledge legally........................

If the property is in your father's name, then you are the legal heir to the property. If your aunt's name is not mentioned on the property deed, then you can ask her to leave the property.

There are two families involved the first children from the first marriage (three of us) and the second set of children (six of them) parents were not married. My father passed away and before he could sign over power of attorney to me he died and left no Will but left a house fully paid off, but the second family had not paid the taxes therefore it had a tax lein. Someone bought the Tax Certificate and had the second family of six children sign a quitdeed for release of their interest. What does that mean those six are no longer involved in this process? Does the person who has the tax certificate own the protery to rent it out?

As far as I can understand, the property has been sold off at a tax sale. The person purchasing the property is the owner and the six people who earlier owned the property have no rights on it.

My dad parents are deceased and the deed is still in his parents name and he have one sister and two brothers but my dad have been paying the property taxes for four years.How can he get the deed changed into his name since he is the only one that have been paying taxes on the land. And if he can get the deed changed into his name and he wanted to sell the land can he do so without getting permission from his brothers and sister.

Your dad, his brothers and sister are the heirs to the property. Though your dad is paying the taxes, his brothers and sister do have heirship rights in that property. However, if your dad's brothers and sister agree, then he can file an affidavit of heirship in his name and get the property transferred. In that case, if he sells off the home, he won't have to take the permission of his brothers and sister.

My wife passed away and she had land in her name. She has three children living. There was no will. Am I heir to her poperty as her husband or are her children heir to her poperty. She has owned the land for over fifty years which was deeded to her by her grandfather. We have been married over thirty years. Can i sell the land if i am heir to it.

Hi Moment,

You as well as the children are the heirs to the property. You and the children will have to file an affidavit of heirship at the county recorder's office and get the property transferred in your names. Then you'll be able to sell off the property.

My moter is an heir to property that her father left. There is not a will. However, her brother which was also an heir died. His sons are having the timber on the land cut without my mother's consent. What can she do?

Hi Dene,

They should take your mother's permission as she is also one of the heirs to the property. In my opinion, your mother should contact a real estate attorney and check out what actions she can take against them.

I do not get along with my family. My grandmother passed away in Nov 2010. She had no will made. She has 4 daughters and 1 son that can not come up with the land taxes owed. The property is gonna be sold at auction for taxes due. If I pay the taxes on the property do I have any claim to it?

Welcome AngelaLynn,

Paying the taxes won't help you in claiming the property. You have to ask the heirs of the property to transfer it in your name. Unless they do so, you won't be considered as the owner of the property.
