can i do lien to a person that own me money

this home owner (my brother in law), owned me about 20k, does possible to sue him , do lien to his home? he took the insurance money without my concern. I bought a house to renew and to sell it. he will take care of fix it , the house had hurricanes damage. ,the insurance sent 1st $5,700. given to him to soon repair the house. the insurance sent a 2nd check of 11k , and took it and it change, without my knowledge.he was living in the house about 1.5 year, never paid the taxes or insurance. He rent the property to thirds without my knowledge .

Was there any written contract made out between you two that the monies are to be used for repair purpose only? To sue him you will have to give some proof that he has misused funds which were supposed to be used for repairs but he has not done anything with those funds.

I guess you have asked your brother-in-law to take care of the repair work in the new home. But he hasn't paid any property tax or insurance on it. And, he has even rented the property to a third party without your knowledge. There has also been some problem with the insurance money. Well, you can ask him to provide you with the money for paying taxes and insurance.

The tenants may have a contract with the person. But as he isn’t the owner, he shouldn't be signing on any contract related to the house. And, I doubt whether such a contract will be legally valid. So, you may have to consult an attorney over this issue.

In case you are interested in talking legal action against your brother-in-law, the attorney will help you out. But do not fall into the trap of spending a lot of fees for the services of the attorney.

Your hard earned money shouldn't go waste; so talk to an attorney and ask him how he can help you. If you think that he will be able to provide you with the right solution, you may allow him to manage your situation.
