Simple assumption

I'm divorce and my exhusband retained the marital home for six years. He walked away from the home causing it to go into foreclosure. When i found out i had to filed bankrupcy to stop the sell. The Bankrupcy has been confirmed. I have been making payments on the home $3200 for the past year. Can we do a simple assumption to remove him from the note and allow me to assume the note.

It will depend upon your lender whether or not he will consider allowing a simple assumption. However, as you have filed bankruptcy now, the lender won't consider any of your request unless the bankruptcy is discharged.

Hi Deborah,

Once you have filed bankruptcy, the lender won't consider any of your request now as there is an automatic stay on the lender. Once the bankruptcy filing is discharged, then you can consider assuming the loan.
