My gf is on the deed/title of the house, i put her on it because she lives there and has always paid her half of the household expenses from the beginning. she is not on the mortgage due to credit reasons just me. We are probably 40k in value less than the mortgage is (economy) i guess. Is it her house or mine? Who has the right to stay if we breakup? I dont think she can afford it. If i have to go, do i still pay? I will not do this again. Any advice would be appreciated.
The breakdown, per the details you provided is this - you are responsible for paying for the house, but the house is both of yours. If you breakup it would be similar to any divorce - how do you determine who stays? Either way, you will be obligated to pay for the mortgage, if you do not, the house will be foreclosed upon if she doesn't pay. If the mortgage goes in foreclosure, this would only effect you, not her (credit, leins etc)

Both of you, because you're both on Title 50/50

It doesn't matter - she's on Title.

Yes, because you're on the mortgage note.

It was good while it lasted - she did pay 50% of everything, which enabled the two of you to enjoy the place. During our lives we all say "I will not do this again" more then once ... experience is a great teacher.
