I modified my 1st mortgage in 2009 when my father passed away. The loan was under my late fathers name only however, title was under my father, my mother, myself and my boyfriend. I am now trying to do an assumption and they are requiring my boyfriend to be remove from title. I don't know if we can run into any legal problems as we also have a 2nd lien with the same lienholder as the 1st and is only under my boyfriends name. Please advuse

in order to assume the loan, you will have to remove your boyfriend from the property deed. however, as the first mortgage is solely under your boyfriend's name, you can't remove him from the property. in such a situation, you need contact your lender and go for a refinance rather than assumption of the loan.
