quick claim deed

hi,
i live in michigan and i am separated from my husband and 2 years ago we filed a quick claim deed,so i could refinance the home in my name and be responsible for the debt.now i have gone to refinance the home and the abstract and title company is saying that my husband who i am still legally married to must sign the papers for the mortgage to refinance.i explained that this is why we done the quick claim deed 2 years ago,because he didn't want to be responsible for any debt.there saying michigan law says if i'm not legally divorced,that he must sign the mortgage to refinance.is this correct? i don't even know where he is now.

quit claim deed only transferred your husband's interest in the home to you.

the actual purpose of quit claim is to convey a person's interest in the property to another person.

Hi Yooper,

Quit claim deed did not remove your husband's name from the mortgage.

The person in whose name the mortgage is taken has to still continue with the mortgage payments.

Hi,

You may have signed a quit claim deed but that does not remove your husband's name from the loan. Since your husband's name is on the loan, so he may have to sign the legal papers for refinance.
