mortgage company sued for wrong practices

I'm in the same predicament. My mortgage company was sued and loss there was a class action lawsuit which we won, my mortgage company (ARGENT) sold my mortgage to (AHMS Inc) who is a servicer and charged my mortgage off in Aug 2010. Haven't made payments for over 3.5 years no contact what so ever. Now I received a signage on my door to call (Real Time ) who now services our mortgage. If my mortgage company went bankrupt can they collect? It's this breach of contract? Can I try to settle with them? Help please... :cry:

You can try and settle the mortgage payments with Real Time provided that are ready to settle it with you. You can contact a bankruptcy attorney and take his opinion as to whether or not the collection agency can collect the debts when the lender files bankruptcy.

May be the lender has sold off your account to the collection agency. In that case the collection agency will have the rights to collect the debts from you. It will be a good idea to settle the debts with them.
