Hi Derek,

Welcome to Mortgagefit forum.

You can use a quit claim deed to get the house from your mother. On the deed your mother will be named as the grantor and you as the grantee. After the deed is filed properly you need to get it notarized and recorded with the county recorder's office which will complete the process of title transfer in your name.

Please go through this following page to know more about quit claim deeds and how to properly use them - http://www.mortgagefit.com/quitclaim-deed.html

About the deed form, for that you can download it from this page - "http://www.co.chautauqua.ny.us/legis/Legislation/05_04_27-RES%20-%20QUITCLAIM%20DEED(s).htm"

If the deed is correctly done then you become legal owner of the house and would not face any kind of problem regarding ownership of the house while taking the mortgage.

DEREKARTETA, it would be more appropriate to take help of an attorney rather than doing it yourself.
