Abandonment

My ex-husband and I seperated almost 3 years ago. Since that time I have been paying for the mortgage on my own (although the title is still in both of our names) and have been the only one maintaining the house, paying the property taxes, taking care of all betterment to the property and paying all of the bills on the house. As well, he does not pay me any child support, regardless of our agreement, for our 2 children, so I support them 100% in addition to keeping a roof over their heads and mine. Is there a way to have him removed from the mortgage, through abandonment or something of that sort, without having to requalify through credit or anything to have the property moved only into my name? The mortgage company is aware of the situation and knows that I am the one making all of the payments to keep the mortgage in good standing, which it is. Any advice is appreciated. I am located in Ontario, Canada.

as far as i know, you will have to refinance the property in order to remove his name from the property. but as you have mentioned that your lender knows your situation, i would suggest you to speak to him about the process of novation. this is also a way of transferring the mortgage from one person to another. though lenders prefer refinance over novation, in your situation, there is a chance that the lender will accept it.
