my boyfriend gave his x the house has not lived there in years sign papers that he couldnt take it from her he wants to clear his name from the house n needs to know his rights n how to go about it with out problems his name is on the morgage n the deed what should we do? hes wanting to finalize everything n move on now .. if your boyfriend wish to remove his name from property deed & also from mortgage then he have to refinance mortgage to his ex & to remove his name he have to sign a quit claim deed by help of his attorney. after refinancing mortgage & removing his name from deed by signing a quit claim deed he will not be responsible for house & mortgage payments.

Hi Candy,
Your boyfriend will have to sign a quitclaim deed and transfer the property to his ex. After he does so, the ex will be liable for refinancing the mortgage in her name. Once she does so, your boyfriend will be released from the liabilities toward the property.
