Is there a statute of limitations?

Well, the Chapter 7 that we filed was final in March 2008. As a part of the bankruptcy plan, we decided not to reaffirm a vehicle loan. The loan was paid down to 10k. The judge asked if we wanted the vehicle picked up and we said yes. However, it has been sitting in our garage since then. My credit report says it was included in the bk. I want to call and ask for the pink slip so I can transfer it. Is there a statute of limitations, or any reason I can give to get the pink slip?

You should contact your car lender and ask him to take away the car from your garage. In case, they refuse, you will have to check out your state laws in order to know the statute of limitations regarding abandonment of assets and when you can make a claim. You may also be able to make a claim for storage depending on the state laws.

You haven't mentioned the state you live in. So, it will be difficult for us to let you know the statute of limitation regarding such things. You can contact an attorney and he will help you in knowing the statute of limitations. Apart from this, as Sara has suggested, you should contact your lender and ask him take away the property from your garage.
