Can a collection agency still call me weekly if I am paying?

Posted on: 29th Dec, 2010 10:26 am
Can a collection agency still call me while I am actively paying off a debt? I get weekly calls from an agency telling me what I am paying is "not good enough" and they want my banking information. Can they do this in north Carolina?
Hi mina!

Welcome to forums!

If you're paying off the debt, then the collection agency cannot call you or harass you for payments.

Feel free to ask if you've further queries.

Thanks! I didnt think they couls but this woman is relentless. We are paying about $20 a month towards a $1400 balance. So while it is a small payment, it is on time every month and made directly to whom the debt was made. The office we owe the money too is totally agreeable to the amount we are paying. The collection agency said it "is not enough". Blood from a stone, anyone? What can I say to this woman, and where can I get a legal quote/law quote to give here to stop her phone calls? How can I stop the phone calls? She wants my banking account information, and wants me to give her my debit card information! (I will not do this, but she is asking for it) Thanks!

Hi mina!

Welcome to forums!

You should contact an attorney and check out if he can help you in taking the required steps against the collection agency.

If you truly think you're being harassed, you can save the lawyer's fees and contact the Federal Trade Commission (ftc.gov) and ask for them to intercede on your behalf. You might want to tell your favorite collection agent that you'll be doing this; then again, maybe you won't.

Why wouldn't I tell them? They called again today. We just made our monthly payment - on time. WTH is wrong with these ppl?

Hi Guest,

If you have made the payments on time, let them know about it and ask them to not harass you any further. If they are not willing to pay heed to you, contact an attorney and take legal actions against them.

Thanks

No, James...I disagree. Why retain a lawyer and sue? Matters such as debt collectors harassing people are more appropriately handled by the FTC, which has been given the responsibility and the authority to do so already.

Muddying up the court system isn't going to benefit anyone, including our poster.

Guest: Why wouldn't you tell them? I don't know...that was actually pretty much a throwaway line I inserted there.
