Different Debt Collectors, Same Debt, 2 Different Judgments?

Posted on: 10th Jul, 2009 08:20 am
We recently received a letter from an attorney acting as a debt relief agency in regard to a judgment that was filed on us June 24 of this year. We have received no papers pertaining to this judgment, and we actually suspect that this is a different debt collector for the same debt that was used last year for a judgment that we were never served papers for. They tried to serve us papers when we were out of town last November, but we were never actually served. Now it is on our credit. What can we do about that, and what can we do if we find this current debt collector is pursuing the same debt as the old? It is originally from HSBC, sold to LVNV Funding, and the "new" judgment/debt now is with Dodeka LLC. I've seen all three names tied together before, which is why I am suspicious.

Thanks so much for your help!
have you ever gone to the court to find out what transpired? of course, you are correct in thinking that two different creditors seeking the same repayment isn't right, but it may just be that lvnv gave up the ghost and figured they'd never get your debt collected; hence the new agency. it's worth digging into a little bit. if you are homeowners, you'll need to understand that a lien can be filed eventually, which would cloud your title.
