If there are unpaid R.E and School taxes at time of deed in lieu do I have to pay them?...I have not paid my mortgage for 7 mths, I am trying to do a short sale, not very successful, so am considering deed in lieu of foreclosure.I owe real estate taxes and school taxes, how is that handled. Do I need a lawyer to do deed in lieu of. I live in New York State, Nassau County.

If there are unpaid real estate and school taxes, they should be paid off before you go for a deed in lieu foreclosure.

You don't need a lawyer for deed in lieu. You can negotiate with the lender yourself and hand over your property via deed in lieu.
