Hello:
We were just served with papers (civil summons/complaint) from a sheriff today to foreclose on our home. I am totally perplexed.
I have been working with my lender for over 1 year. We have suffered a tremendous medical/financial hardship since the summer of 2007 when I lost my job due to the firm I was with going out of business. I collected u/c for 6 months; however in December of 2007 my husband was injured on the job (federal employee) and was out of work without pay for 7 1/2 months. He underwent several e/r visits; numerous doctor visits; injections; and eventually surgery in April 2008. He could not walk for 3 months. I had been in touch with our mortgage co. and explained the situation. We were granted a "medical foreberance for 6 months wherein we made 1/2 month payments and were in hopes of doing a mortgage modification at the end. Due to unforeseen circumstances we missed 1 payment in January 2009 . I called a HUD specialist who joined in on the conversation with my mortgage co. and I was inquiring about and/or trying to apply for this "Obama stimulis grant to help homeowners in need keep there homes. She told my to fax documentation to the mortgage company (financials; new hardship letter etc. which I did and she told me that things looked good for me to qualify for this program..! week later..today, Easter Eve, we were served with foreclosure docs by a sheriff.....
Can anyone out there help me? We are behind on all of our bills and have a child who grew up in this home. We have lived here 17 years and I am devistated. I have been applying for work on a daily basis getting nowhere with the hopes of the next interview being the one..

Hi Roberta,

You have mentioned that you have faxed a new hardship letter and other documents to the lender. Did the lender contact you after that? In my opinion, he should have informed you if your mortgage modification was not granted. I would suggest you to contact your lender once again now and try to negotiate with him so that he agrees for a loan modification.

thank you for your reply. They never did contact me after I faxed 13 pages of docs. The fax went through ok (faxed at Staples) and I never heard a word from them until the sheriff dropped off the summons yesterday. I will try and call them Monday. It can't hurt.

Welcome back to forums!

I agree with James that they should have contacted you once they received the fax from you. Yes, do make it a point to call them and negotiate with them. Check out if the lender can give you any option. Do let the community know what options your lender gave you. This will also help others to deal with their lenders who are in a similar situation.

I have read your case, and want to give few suggestions on this:

1. People who are facing foreclosure now have another way to get back on their feet and allows them to work out better terms with their lender, and pause the foreclosure process while negotiations are under way.

2. Common reasons for mortgage loan modification include medical emergencies, death of a family member, and unexpected job loss.

3.Borrowers should also have a source of income, as they have to prove that they can stay current once they get the mortgage loan modification.

4.To get a better response, it's best to hire a loan modification attorney who will do the negotiations on your behalf.
