Hello, I will try to keep as simple as poss. I did foreclose in 2008 and did have a second with National city which has now gone out of business. Credit report shows closed. Just about a month ago Pacific Heritage financial has been very threatening with me on this specific loan. I am in Az this co is in Tx. All their actions and letters have been very unprofessional. The premise of the interaction has been that I lied on my second loan, income and place of employment. I cant prove without a doubt that I did not lie about anything, I lost my job and thats it. If I settle with this Micky mouse co. how do I assure myself that this loan/debt will go away for good. How do I know who I am giving a large sum of money to? If you look up this co. the first 5 hits state its a fraudulent co. I am very lost in this new environment and having many sleepless nights. Is it worth going to court with this co? Also the payoff contract is worded in a way that it shows that my payment is only an initial payment and the co can continue to pursue the total amount. Full amount is 29K. Thank you.

Firstly ask them to validate the debt.There are plenty of debt validation letters samples are available on the internet.So if they have the right to collect the debt from you then we can proceed ahead,if not your problem is solved and you can directly sue them.

If it's a fraud company, then you shouldn't pay any money to them. You should, rather, contact an attorney and ask him to deal with the company. In case, you find that the you need to pay them money, then you should sign an agreement with them regarding a final settlement amount so that they won't be able to come after you in future.

This company contacted me with a very nasty letter saying that they are going to sue me for mortgage fraud on the second loan if I don't provide tax returns for 3 years and other documents. I am very desperate because I don't have any money, I lost my job, my house and my marriage. I contacted an attorney but this is moving very slow. I don't know what is the right thing to do. Do I settle with them or do I let the attorney handle it. Please keep me posted on how this is going for you.

To all those on this post. Do not, I repeat, do not be intimidated by them. Call the FBI, your congressman, senator, and tell them of their scare tactics.

Tommy D lost his case! If you did not lie on your loan application than simply prove it, if not you should probably settle! Not because you could lose in court, which you probably will if you did lie, but because it's the right thing to do. Do you really think getting a lawyer is gonna help? All your lawyer is gonna do is charge you a huge retainer and tell you that he will defined you when really he is just running up your legal bill and then tell you to settle when the smoke clears. Lawyers are crooks! Trust me, I have been there! Good luck
