My husband want me to move out my home.

I am married to my husband for 11 years, we move to the state of Florida 7 years ago. Our home morgage is under my husbands name, but my name is on the Deed. He bought me a car, but I make the payments. Now he wants me to move out the house and leave the car behind. He said he would help me with a down payment on a rental. I have to buy a car for myself. I am not allow to leave with the car I have been making payments since day one a little over a year ago. 50% to 75% of my paycheck goes direct diposit into his accout. What are my right here? Please help.

If the property deed is in your name, then he won't be able to remove you from the property forcefully. However, if you transfer the property to your husband, then he may remove you from the property. As far as the car is concerned, if it is in his name, then he may ask you to leave the car behind.

Hi Rubenstw,

addition to James point of view. it also depends on what kind of tenancy you both had on property. for example, if your husband bought this property during the course of your marriage...you must have equal right on the property.
Check your case will falls under Community Property category or not.

Their web site appears to be a bit vague but hints at a combination of budgeting with any free cash going to curtailments (after siphoning off 10% for themselves) with resultant actual loan durations of between 5 and 25 years. Somehow they arrive at the 'nine years' but a weighted average of the 5 and 25 year terms.

If you have free cash to apply to the mortgage balance and want to reduce your remaining mortgage term, why pay them 10% of the 'savings' Even if you are not a well-disciplined individual and 'need' such an overlay, make sure you don't send the funds to them for re-transmittal to the lender. Many lost cash than way in the third-party bi-weekly game. Their site doesn't specify funds pass through them but don't know how they'd rake off their 10% otherwise.

These calculations are not rocket science. Write a simple Excel program and see what makes sense to you. By doing it yourself you'll have another 10% to pay off the mortgage even more rapidly.
