i had a divorce 1 year ago, the house is mine, there was a refinance in 2006 of the house, i was at the closing, there has been an equity on the house, the documents for that specific loan is soly to my ex as the grantor and also stating him as an unmarried man( of which he was married at the time) they made me sign the 3 day notice cancellation of which he is the grantor and they did not make me sign the closing statement??? he has not made any payments on that loan for 1 year, i am now facing foreclosure eventhough i am making payments on first mortgage which funny thing he was married on that one. how can i make a payment of a loan i have no acess to and not the grantor. he has took all the money out and left the country. am i responsible for that loan???

I would like to know few things which will help me to answer your query in a better way. You said that there was a refinance of the mortgage. Was the refinance done in order to transfer the mortgage in your husband's name? If yes, then you must have signed some deed giving away the property to him. I think you should check that deed once as all the details will be written there.
You said that you signed a 3 day notice. Can you be more explicit and give details as to what it was?
Moreover if the property is in his name and also the mortgage, then I don't think you need to worry as the foreclosure of the property won't affect you or your credit.

inasmuch as syljac is the occupant of the home, i think there might be some impact on her life if the foreclosure takes place. yes, her credit will not be impacted; but certainly the rest of her lifestyle will be.
syljac...find out what you need to do to take care of the payments on that second mortgage and do your best to make them, if you wish to keep that home. by all means, hire an attorney to represent you, and to ensure that all the facts are on the table about the deal.
