ASC & Wells Fargo mishandling of account

I have ASC (America's Servicing Company) and Wells Fargo as my lender and though I know most of the posts I read are old, is anyone else out there going through or getting ready to go through a foreclosure with them? I have had the same problems that many posted here with them not returning my calls. I even spoke with a supervisor one time and the person still never called me. Their avoidance has now caused me to get a letter of foreclosure. I just wrote a 3-page letter to them today, though I don't know if it will do any good. I have sent in hardship letters for the last 3 years along with my financial worksheet and each time I am denied a load modification or any assistance. I advised them about 2 years ago that my fiance and I split up so I could not make the high payment of $1643/month...I am now about 5 payments behind. They will not work with me and I don't want to lose my home. Any help or suggestions please?

There are several things you can do. You can start by sending in a Qualified Written Request to the lender, demanding that they prove they have the orignal note you signed. If you cannot get the bank to work with you on the loan mod, then go for the legal side. If you are not able to get the bank to prove to you they hold the note, then take them to court and demand the court have the bank prove they are the note holder, by showing the court the promissory note you signed. If these dont work out, your next option is to cure the amount that is in default. Depending on what state you are in, you have a set amount of time that you can cure the past due and save the home from foreclosure. If that is not an option, then get a good real estate agent who specializes in Short sales. Your other option is Deed In Lieu, or your last option is the foreclosure. Foreclosure will kill the credit and bar you from owning another home for 3-7 years. Good luck-

Welcome to forums!

If you cannot deal with your lender on your own, you can contact a real estate attorney and take his opinion in this matter. You can even ask the attorney to negotiate with your lender so that you can qualify for a loan modification.
