Auction during loan modification

The lender sold my home at auction while I was negotiating a workout. I was told the foreclosure process was on hold until they responded. I did not receive any notice of denied workout or of this auction date. I sent in requested financial information a week ago to the workout negotiator assigned to my case.

The lender should send you a pre-foreclosure notice before selling off your property at an auction. It is quite surprising to me that they haven't done so. I would suggest you to contact your lender and speak to him regarding the whole issue. He may be able to give you the clarifications.

I called my lender to see if they could help me save my home and stop my sale date of november 5. I was told I had to provide the items needed by oct 28 before they could even speak to me about postponement of sale date. I got all items in on 10 /25 and they gave me a financial interview and stated I would be reccomended for MHA I was assured that with this pre approval and it stops my sale date. I was told that it my file will now be assigned to home preservation and would get a call in appx a week. I called Wachovia to let them know I have yet to receive a call and was told they never stopped the sale as they should have and it was sold.

It is quite surprising that the mortgage lender sold off the property when you were going through a loan modification. The lenders generally stops the auction when you're being considered for modification. I guess your modification was canceled by the lender and as a result they went on with the sale.

Did you get a sale date notice? Usually the lenders will postpone the sale date, however, if your application for a loan modification was incomplete and lender was not getting responsive answers from you, then it is possible they sold the house. Get a lawyer if your mortgage holder was BOA you have a case. Another screw up with BOA at the helm. See what happens when politicians and bankers scratch each others backs
