NAME OFF MORTGAGE AFTER DIVORCE

i have been divorced approx 2 yrs.my ex bought me out of the house & has been making mortgage pymts .i just learned by applying for a mortgage that my name was still on that house we had.why wouldn't my name automatically be taken off the mortgage at time of divorce.it says in divorce papers she is responsible for mortgage pymts & that she bought me out.now 2 yrs later i find out i am still on there.beside going to assumption dept at mortgage company is there any other avenue i can look into.they r telling me she will have to refinance etc etc.she may not want to be bothered & where does that leave me?is my next action court? Only way to remove your name off the mortgage is to ask your ex to refinace

Call your ex and speak to her to get this doen first, if that does not work, then you need to take legal action

But rememeber since the loan is current and your ex has been making payment on time, that is helping your credit report

Hi ESPO,

Your name cannot get removed from the mortgage automatically. Your ex will have to refinance the mortgage in her name in order to remove your name from the mortgage dues. If she doesn't refinance the property, you'll not be able to get a mortgage in your name.

ask your ex spouse to refinance the mortgage . it will automatically remove your name from mortgage

you can also ask your ex spouse to assume the mortgage, then your name will be taken off the mortgage.

As Realgeni said, if the mortgage payment is current, and if your name is on it, it would actually help your credit score.
