Jail for non payment of consumer loan

Posted on: 29th Sep, 2010 07:08 pm
Can I go to jail for not paying a consumer loan?
I took out a small consumer loan with Sun Loan Company. It was not a payday loan and no checks changed hands. Since then, I was in a terrible car accident and am now on SSI and Social Security. I did move out of state because I have 3 children that I could not take care of due to the accident. They are now calling my family everyday, threatening to take me to jail, telling them it will be considered theft over 1000. Which I dont understand because the loan was only for 250.00. What are my rights here and how can I get this resolved without going to jail? Thank you, Paula
Paula, you need to contact the Federal Trade Commission and file a complaint against these morons. There is no such thing as someone being forced to go to jail for non-payment of a loan. Of course, if you pay it, they'll get off your back.

But their tactics are illegal, and they can be fined heavily if the FTC finds out this is their regular method for collections.
You can check out the FTC online at ftc.gov- there is lots of information out there for consumers.

Don't let them harass you and your family - fight back!
