can I take my ex to court for my 35%

Posted on: 13th Jun, 2010 06:37 am
my ex husband and I bought a building for business in 2000 my name is on the mortgage but Im not sure if it's on the deed. in the divorce he was suppose to give me 35% when he sold the building. He had 90 days to sell the building he never did.I found out recently he took two personal mortgages agenced the building in 2006 right before the divorce, and never paid it back. The people he borrowed from are now forclosing on the building. My name is also on the forcloser papers even though I didn't even know about the mortgage.
Do I still have a right to my 35% of the building?
As your name is mentioned on the mortgage docs, you're responsible for the loan payments. If the property is foreclosed by the creditors, then you won't be able to claim the 35% ownership of the property, in my opinion.

Hi,

If your name is on the mortgage you are still responsible for it even after divorce. As you said it is mentioned in the divorce decree that your husband needs to pay 35% of the building after the sale you can consult with a good divorce attorney and check out the options open for you.
