a little understanding

My husband and father in law bought a house 2 years ago this summer. My question is this... My father in laws name is on the mortgage and bils when they come in the mail. My husband was put on the deed and he pays the mortgage and always has....... what rights does my husband have in reguards to residing in our home without my father in law trying to kick him out? Also does this mean that the mortgage is based off of my father in laws salary or my husbands or both?? I would like to see if my husband qualifies for the mortgage modification program but unsure how it works as far as whose salery they use.

Welcome to the forums!

As your husband's name is on the property deed, he is the owner of the property and has the right to stay in the property. Your father in law cannot force him to leave the property. If your father in law's name is on the mortgage, then his income will be considered by the lender when you apply for a loan modification.

Thanks Sussane! I have another question? Can my father in law put my brother in law on the deed... and then when he dies my brother in law has rights to our property.. even though my husband pays the mortgage and always has?

Welcome back felicia,

Your father-in-law can add your brother-in-law's name to the property deed. As your husband's name is already on the property deed, both your brother-in-law and your husband would share the property when your father-in-law is deceased.
