my mortgage co., res mae mortgage, gave me a 5% rate for 2 years variable rate, and the mod papers said 30 years at 5%, i called and was told that it was a 40 years with a variable starting in 2 years,do i have a chance to get this chanced or re moded again? also my 2nd mortgage was not included as promised.

you may have to refinance the loan in order to change the terms and condition of the mortgage. as far as the second mortgage is concerned, is it with the same company? if not, then you'll have to contact the concerned lender and get the mortgage docs.

both loans w2ith same company, i think that i need legal advice ,but not sure where to start.can you do a second remodification?

You can apply for a second modification of your mortgage. However, it will be your lender's discretion whether or not he will give you a mortgage.
