1031 and Quit Claim deed

Posted on: 22nd Sep, 2013 04:07 am
I currently own 50% of a house with an x husband. I would like to buy him out, he would like to do a 1031 with his portion. Can he sign a quit claim deed to me and still do a 1031?
Hi AZ,

This is something which an attorney will be able to better clarify. You and your ex should get in touch with an attorney and sort out the matter. But as far as I can understand, after quitclaim, a 1031 exchange will not be possible.

Hi AZ!

Welcome to the forums!

I agree with Adonis. It will be better if you could get in touch with a real estate attorney and take his opinion in this matter before opting for quitclaim deed.

Feel free to ask if you've further queries.
