Husband died; I want property

My husband passed away recently and I was not on the deed to the house or truck title (both of which are still being payed for). He didn't have a will; we were separated at the time but I want to take over the house and truck but do I need to qualify to assume the loan and put the property in my name? It's been over a month and the property is in his name only.
you are mentioning that you are seperated. I belive that you have not taken divorce.

you can submit death cerificate of your husband along with affidevit of heirship to get property in your name.

sorry to hear about your husband's death.

Do you get death certificate. submit to state's office with proof of your marriage.
Does your hubby married with any other woman as you stated that you were separated?
Please clarify.

He didn't have a will; we are still (were) married at the time of his passing and he was not involved with anyone else. Our children are all grown and want nothing to do with the property.

Hey karen,

As your husband has not left a will, you can file an affidavit of heirship and transfer the property in your name. You will also have to submit his death certificate at the county recorder's office.
