quit claim deed

Posted on: 29th Jan, 2014 11:50 am
I went to chapter 7 and they included my house, even when I made clear I wanted to keep it, any way, now is discharged, that's happens in 2011, now I'm traying to by me another house, at the same time started a "deed in lue" process on august 2013 and I'm still waiting to see the end, because I can not buy until I'm free from the first one, someone told me to do a quit claim deed, giving back the house to the lender, could it be done that way?. Thanks!. All this is in Florida.
Hi Manuel!

Welcome to the forums!

Yes, you can quitclaim the property and surrender it to the lender. The lender will then complete the deed in lieu of foreclosure process.

Feel free to ask if you've further queries.

Not sure about just quit claiming in this situation
You need to work with the bank - keep in mind that because the home was included in the BK it is considered a foreclosure from the date that it changes OUT of your name - which has not happened yet currently FHA os the quickest but it is still a 3 year wait after you transfer the home out of your name - so it will be a while before you can buy a new home

Hope it all works out
