My father passed away 5 years ago. I am one of 3 of his children and live outside of Texas (where he lived) him an my mother divorced in 1973 and he was never remarried. My brother who lives in Texas sent me an affidavit of heirship to sign for 3.33 acres of land my father owned in Texas. If I sign this what will happen? If I don't what will happen? How do I make sure I recive my share of the land?
The affidavit of heirship will transfer the property to the heirs. Make sure you are listed as an heir. After it is filed, you own the property with the other heirs and can sell it or whatever.
