Remove my name from a Timeshare contract

My divorce decrees states that I would quitclaim my interest in a timeshare located in Cancun, Mexico. And that the husband shall be soley responsible for any costs related to the timeshare from the date of entry of judgment of dissolution and forward.

The timeshare company said I could not quitclaim my interest. They are now coming after me for non-payment. He stopped making maintenance payments in 2002. Is there a way I can get my name removed from the contract so that I am not liable for payments?

Welcome to the forums.

The timeshare company should follow the decree that you have received on divorce. Having said that, I mean the company should allow you to take your name off the timeshare. But this does not remove your name from the loan and hence you still have the responsibility of making payments.

If he is not making the payments as the divorce decree states then you should contact an attorney and file a lawsuit to make him obey the court order. He should be paying for all the expenses that the court order stipulates.

A couple of things.......

Sara.......a judge has no jurisdiction when it comes to a security instrument. In other words just because the judge says the husband is responsible does not mean the lender has to change the terms of the note. The husband can be held in contempt of court but there isn't anything you can do about the situation you are in. You can't just quit claim your self off the deal. The timeshare needs to be sold

my exhusband and I have a timeshare in which I want my name removed from the title. The account is managed in Florida and he recieved ownership in the separation agreement from 5 yers ago. He apparently has not been making payments and now a collection agency is calling me. Can I file a quitdeed from Canada, where we live. I am afraid that my credit rating will be ruined and am scared to go to Mexico again...what can I do about this?

Welcome tracy,

As far as I know, you won't be able to file a quitclaim deed from Canada. Moreover, if you transfer the property now, it might be considered as fraudulent as the collection agency is already calling you for the payments. I would suggest you to contact an attorney and take his opinion before taking any steps.
