Can my husband add my name to his portion of title in a joint tenancy?

Posted on: 07th Apr, 2009 02:40 pm
My husband is joint tenant on his property along with his mother and father. each own a third equally. My husband is the loan holder nad only person paying the mortgage. His parents don't like me and are trying to remove me from the house. His parents have never occupied the house, and my husband has been living there since 1995. Is it possible for my husband to add my name to his ownership without his parents being involved?
In many states the spouse automatically have a vested interest in the all real estate the that is own by the other spouse, meaning that your husband and his parents can not sign the deed and give clear title to the buyer unless you sign. So no need to worry. But if you want your name on the deed than he can deed it to to by deeding the house to "himself" and "you", as husband and wife with a 1/3 interest. check with a Re lawyer in your area.

Hi marlasinger,

If you are in a community property state, as Ann had mentioned, you are entitled to a share of the property owned by your husband even if you are not on the title. If you are not in a community property state, you can still be added to the title through a quitclaim deed by your husband without having to consult his parents. However, in that case the joint tenancy form of ownership would change into tenancy in common.
