Deceased Landowner With No Will

Posted on: 21st Sep, 2013 09:40 pm
My husband and I divorced in 2010 the land where we were living for over 30 years belongs to his grandfather who is deceased. I'm still living there . Can I do a quitclaim and open succession to the estate? The grandfather is still the owner and succession has never been open.
Hi Kacie,

If you wish to own the land, then you will have to speak to your ex husband and ask him to transfer the property to you after he files for an affidavit of heirship.

Hi Kacie!

Welcome to the forums!

I agree with Adonis. The property needs to be first transferred to your ex-husband and then he can transfer it to you.

Feel free to ask if you've further queries.
