Husband deceased 11/08. Property jointly owned. No estate opened. Mortgage company in process of lowering house payment. Wants property in my name only. County clerk said get new deed form from office supply, have notarized, and submit with $10.00. Already sent death certificate at cost of $10 to register with clerk of court. No such form found at office supply store. Pleasse advise proper form to get. Thanks

I would probably just go to a local real estate attorney to have them type you up a new deed and then you would just have to take it to the recorder's office at your local courthouse (after notarizing it of course)to have it recorded. Atleast if you go with an attorney you know that it will be done correctly and it won't cause you any headaches down the road.

I agree with Scott in this regard. You need to contact an attorney and get a new deed form drafted as per the county recorder's requirement.
