Lady Bird Deed

Posted on: 05th Aug, 2012 09:28 pm
My Mom just passed and I had Power of Attorney over her. She signed a Lady Bird deed leaving her land to me. The lawyer who drew up the lady bird deed is deceased too. I guess my question is do I need to file this deed to have the property put in my name.

Since you have the Lady Bird deed in your name, it will not be difficult to take possession of the property. Since, the attorney who drew up the deed is deceased, it would be wise to take the help of some other attorney. Unless the deed is filed, it won't be considered as legal. So, you should contact the county recorder's office and get the property transferred in your name.
