Lien on House - Owner/financer cannot be located

Three years ago, I helped my daughter purchase a starter home. She paid money down and it was owner financed for $12.5k. The loan was for three years and will reach maturity in April - next month. Not long after my daughter had moved in the house, all mail (mortgage checks) to the lender were returned with no forwarding address. We sought legal advise and were told to send him a certified letter. It also was returned with no forwarding. My question is, if we cannot locate this person, how do we get a lien release on the property. She would like to sell it and move into another house but cannot sell due to the lien. The house is in Shelby County Tn and we have not been able to get any guidance from the county office. Please help!

It will be difficult for you to get a lien release certificate if you can't locate the concerned person. You should contact a real estate attorney and he might help you in this regard so that you can take the right decision.

You can still sell the house and put the proceeds for the lien in escrow. Then, after the statute of limitations has run on the contract (usually 4 years from the date of the last payment), you can go to court for an order releasing the funds to you.
