Sick Father

If my father remains too sick to come home and has to stay in a nursing home for a long period of time until his insurance and medicaid run out then as I understand they will come after his assets for payment. His home is paid for but my question is can he quick deed the house to one of his children so that the nursing home will not come after it for payment. He worked very hard all his life and this is his only real asset which in his will is to be sold and divided amongst his children. Please advise.

Your mother can rent a portion of her property and she can use the rental income to pay off the taxes and insurance.

My grandmother is in the nursing home and receives medicaid benefits. I have dealt with Medicaid for 4-5 years. She still owns a small piece of property, .7 acres,in Florida that I have kept on the market for 4 years. We have had one offer that was withdrawn because it is in a location that can not be improved if under 5 acres. According to Mediciad it has to remain on the market and land taxes have to be paid for medicaid to continue benefits. There is another lien from an old mortage she had for around 20k. The property is appraised at 28k but the only offer in 4 years we have had is 5k. How can I plead with medicaid to resolve the lien?

It will the discretion of the Medicaid authority whether or not they would release the lien. You should contact an attorney and he might help you in negotiating with the Medicaid.

MY MOTHER SIGNED THE DEED FOR HER HOUSE OVER TO ME APPROX 6 MONTHS AGO. SHE IS NOW LIVING IN A SENIOR HIGH RISE, IF SHE GOES TO A NURSING HOME WILL THE HOME BE TAKEN FROM ME. I AM CURRENTLY LIVING THEIR AND INVESTED A LOT OF MONEY INTO THE PROPERTY.

The home will not be taken away from you. However, your mother will not be able to claim Medicaid benefits immediately. She will have to wait for 5 years after the property transfer in order to claim Medicaid benefits.

My mother is in a nursing home on medicaid. We are trying to sell the house but it has a mortgage on it. Can the bank forclose on her, or will medicaid prevent this.

If the mortgage dues are not paid on time, then the lender will have the rights to foreclose the property.

My friend signed over her house to the state when she applied for disability. Her 2 adult sons are living in the house. One of them is on disability. When she dies will they be able to stay in the house or will the state take it over. Also if she has not taken benefits equal the the equity in the house what happens then, do they take the house anyway.

Your friend has signed over the property to the state. In such a situation, I don't think your friend's son will be able to stay in the property after her death.

I am about to get a settlement class action suit, My mother rec'd medicare and she owned nothing. No home, car, I paid for the final expense. Would they put a lien on her somehow and take the class action money? We live in Nebraska.
How do I find out if they do have a lien?

You should contact the county recorder's office in order to find out whether or not they have placed a lien on the property.

My mother has lived on the family farm and is the third generation. I have stayed with here for over five years as needed following a fall which resulted in a hip replacement. I have not changed my residence but am there everyday to provide care, medication ect. She recently broke her hip and is in the hospital and we are worried that she may not be home again. I am wondering what proof they look for as to whether or not i live there. I did not change my residence but have a bedroom in the home. My residence is close buy and i live there with my wife but stay with my mother as needed. aI have been told the home must be place in a trust which will matur in 5 years otherwise the farm could be taken by medicaid. thanks in advance for any help.

It will be difficult for you to prove that you live there. Nevertheless, you should speak to a real estate attorney and take his opinion in order. As your mother is the owner of the property, there are chances that Medicaid will take over the property if she goes for Medicaid benefits.
