remove name from title

I had bought a house with my mother. Our name is on the title. I have gotten married but have never signed any papers. We did have a joint account for a year from which we have paid the mortgage. I just paidoff the house on my own. In this scenario, how do I get my name off the title? Is my property at risk if we divorce- well there wont be any since we are not married on paper. Any suggestions?
hello and welcome to the forum. you can use a quit claim deed to add or remove a person's name from title. as far as the property being at risk, i think you should talk to an attorney.

You can quitclaim your portion, but there may be a community property interest held by your spouse. Consult with a local family law attorney.

is there a form for a quit claim deed and does one actually need to spend on a lawyer to file

Hi Claire,

Sample quitclaim deed forms are available online and one can use them in order to transfer property. However, it is always better to contact an attorney and let him check the deed as quitclaim deeds vary from state to state.

is that the only way to remove someone from owning a property - my boyfriend and his ex fianace co-own the house with a mortgage remaining she moved out over 17 years ago but her name is still on the house and the mortgage - we don't know where to find her and actually don't want to find her (just trouble) - I've been living there for 14 years and paying the bills what are our options

If you want to remove one of the owners of the property, then you would require his/her signatures for the same. As you have no idea where the ex-fiance of your boyfriend is, you should consult a real estate attorney and take his opinion in this matter.
