I have since gotten married and changed my last name from what is listed and he has moved out of state. How do we go about filling out and notarizing the form? Do we need to have two forms?

Only you will be able to transfer your share of ownership through quit claim deed as your brother is out of state. It is necessary to get his signatures on the deed for transferring his ownership rights.

Hi Casdgal,

Normally when you change your last name, there is no need to reflect it in the property deed, since it is you who you still are. Many people do it as it makes issues latter with proving identity.

In that case, you'll have to get the deed from the office of the County and record your new last name on it. After completing the deed, you'll have to get it notarized.

Now, when your brother is out of the state, you can transfer the property by using a quitclaim deed and in this case, you will need to fill only one form. You should e-mail a copy of the deed to your brother for his signature on it. And only after his signature, get the deed notarized and record it in the office of the County Recorder
