Avoid probate

My mother has no bills, owes no one. My sister and I are on the will 50-50. She does not have much time left in life, and is a private pay in a nursing home. Mind is 100% sound. Is it best to do a quitclaim deed, so that the house does not go into probate? House is 100% clear in my mothers name. She pays for the nursing home 10K a month. If one owes no-one is there probate?

Hi dprice,

I hope your mother is not taking the benefits of Medicaid. In that case, she can definitely sign a quitclaim deed and transfer the property to you. This will help you in avoiding probate that would have resulted from a will.

Yes. she can sign a quit claim deed and transfer ownership roghts to you & your sister.
