My husband passed away in December. Is probate necessary?

Everything is in his name. He took care of everything. We were married at the time everything was purchased and we have to children. No one will give me any information on the bills etc..... What do I need to do?

If your husband has left a will, then that will needs to be probated. Once the probate is complete, you can then file the will and get the property transferred in your name. It will also help you in transferring the property tax bill in your name. If your husband has not left a will, then you can file an affidavit of heirship at the county recorder's office and transfer the property in your name.
