The divorce papers have been filed but the divorce is not finalized (don't have a Divorce Decree) and I live in a common property state. I want to buy a condo. Will having him sign a quitclaim did prevent him from being on the title?
jen, it seems you're asking about this property that you're about to purchase. if it's to be yours only, your to-be former spouse wouldn't be taking title to begin with, i presume; so a quit claim deed would not be appropriate.
do you have a divorce lawyer? have you posed that question to the lawyer, if you have one? i'd think that'd be the way to go here, unless you're doing the divorce pro se.
