Quit Claim divorce bankruptcy

Posted on: 16th May, 2012 08:56 am
i remarried 9 years ago , i owned a home prior to our marraige , my husband was a mortgage broker we refinanced my house twice, the first time i quit claimed to add him to the deed. the second refinance was in his name only for the loan. through our divorce negotiations he had to quitclaim the house back to me. he did that then immediately filed bankruptcy and included the loan. i was in the middle of trying to refinance which could not happen with the loan in bankruptcy, the court awarded him a no asset bankruptcy because the house was quit claimed. i can hardly even get the bank to communicate with me because i am not on the loan but i am the only one on the deed. i have run the gamut of having loan officers tell me i don't owe the debt to i can't refinance a loan that is not mine even though i own the property.
Welcome Rhetless,

The loan officers are right in saying so. You don't own the loan as your name is not mentioned on the mortgage docs. Now you will have to somehow convince the lender in order to get a refinance. Unless you refinance the loan and pay off the mortgage on time, your property might get foreclosed.
