Quit Claim Deeds

Posted on: 18th Nov, 2013 03:04 pm
There was two quit claim deeds filed on the property. The first states that it goes to my Aunt and Father upon my grand mothers death and was written in 2006 but filed on 06/21/13 and the other one says it all goes to my Father and it was written in 2012 and was filed on 06/20/13 one day before the other deed. Which of the deeds is correct?
Hi clinematthew!

Welcome to the forums!

The deed which was filed earlier will hold more value. You should immediately get in touch with a real estate attorney and take his opinion in this regard. He may check both the deeds and let you know which deed will hold value.

Feel free to ask if you've further queries.

What deed do you mean, the one recorded with the courthouse first or the one that was signed by a public notary first? My Father's deed was filed on 06/20/2013 but drawn up in 2012 and my Aunts was filed on 06/21/13 but drawn up in 2006. So does my Father's deed have more value or my Aunt's deed?

Thanks
Matthew

Hi Matthew!

Welcome back to the forums!

As far as I know, the deed that was recorded first at the courthouse will hold more value.
