Quit Claim Deed Reversal

Posted on: 21st May, 2012 10:00 am
hi all......

about 4-1/2 years ago, my mother gifted via a quit claim deed, a house for my brother and a house for myself (2 seperate properties). now, after all this time and extensive renovations on my part to my property, my brother feels he was "duped" in some way, and now wants to have my property. he has threatened to go to our mother and get her to sign some type of documents to reverse the quit claims - although i do not know what documents he may be referring to. the quit claims were duly signed in front of a notary, everybody was asked if they were signing of their own free will and there was no "duress." they were then recorded at the borough office here in alaska.
i am stressing out on this big time, as i have invested 10's of thousands of dollars of my own money into this property and will be absolutely sick if i was to lose it.
Hi scotthornal!

Welcome to forums!

If there hasn't been any kind of fraud or duress while property transfer, then it will be quite difficult for your brother to get a quitclaim deed reversal.

Feel free to ask if you've further queries.

Once a property interest is transferred via deed, there is nothing the grantor can do to "reverse" the transfer. Only a court could void the transfer due to fraud, duress, incapacity, or other defense, but this would take filing a lawsuit.

As long as your Mother was competent when she signed the Quit Claims, they can't be reversed.
