Release of Lien

I recently paid off my home mortgage. I am not the original Lien Holder on this house. When I tried to get a Release of Lien, the mortgage company told me it was filed with my county records building, but in the original loan holder's name. That was over 30 years ago that this person owned my house.

How do I get a free and clear lien on my home?

I had a hospital attach a lien to my house, it wasnt my bill so I hired an attorney to get them to remove the lien, which they did and they also reimbursed me all of my attorney fees and they sent the original release to my attorney who a year later has not released the lien and who will not call me back. I am in the process of refinancing and I cant wait for the other place to issue a new release which could take up to 30 days.

unless you receive a lien certificate from your lender, you won't be able to refinance the loan. in my opinion, you should take initiate and contact your attorney in order to get the lien release certificate.

I have contacted him several times. I only can talk to his secretary who keeps telling me she is looking for my file. He wont call me back. Im going to lose the interest rate that Im being offered and theres nothing I can do.

We paid off our mortgage in 2007 (we live in Kentucky) the FHA and the services did not release the lis pendens lien on our home, at that time, and sitll has not release this lien. There is also a cross-plaintiff lis pendens on this same lien. What do we do, the cross-plaintiff is trying to sale our home.

Welcome Betty,

Unless you pay off the lien, the plaintiff has the rights to sell off the property. You should contact the plaintiff and check out if you can get a payment plan to pay off the lien.

My husband and I paid off a mortgage in 2003. The bank is now owned by another bank. While doing a title search, it was found that this mortgage does not show paid. Who is responsible for doing a lien release on my property?

Hi Rosemary,

As the bank is now owned by some other company, they will have to issue a lien release certificate. You will have to show the payment stubs in this regard to the new lender.

In the County Tax Lien Certificate Sale of Vigo County Indiana, I purchased the house & property across the street from me, requirements fulfilled I was issued a Tax Deed. Now I want to sell the property. I know the previous Mortgage holder and he filed Bankruptcy in Fed Court. The Vigo County Records show NO Mortgage Release on record. I am concerened that I DO NOT have a Marketable Title. Please Share your wisdom and advice with me...Sincerely.

Unless you have a mortgage release certificate, it will be difficult for you to sell off the property. You should contact a real estate attorney and take his opinion in this regard. You may even contact a real estate broker in this regard.

my credit report continues to show an "open account" from chase for a home equity loan, which was actually closed in feb 2005 when the 1st mortgage was refinanced. chase confirms that they show the account is closed, and the person i spoke to in their home finance department says that means that chase likely never released the lien. is it illegal for them to still have a lien against our house for a loan that was paid off/closed almost 6 years ago? is there any recourse for this being on my credit rating all this time? i've spoken to multiple departments there, with nobody being able to do anything other than confirm that they show the account is closed.

Yes, definitely it's illegal. If you have paid off the loan 6 years back, then they should have released the lien then and there itself. You should immediately contact your lender and ask him to resolve the issue and then request them to report it to the credit bureaus.
