will i be responsibile for the house

i recently got divorced. we purchased a house togather an she is still living in the house. I want my name off the deed. what can i do? I want to be able to purchase another house down the road with my future wife. will i be able an not werry about the other house.

Welcome to forums!

You can sign a quitclaim deed in your ex-spouse's favor and remove your name from the property deed. However, if the mortgage is in your name, then she will have to refinance it in order to release you from your liability of paying off the mortgage dues. Once the property and the mortgage is transferred in her name, you would be able to purchase a new property on your own.

you got a divorce, but apparently the house and mortgage weren't topics covered in the negotiations. if you did a pro se divorce, i can kind of understand that. if you two had lawyers, then shame on them.

you should have ironed out the property issues before you ever set foot in court. oh wel...split milk and all, i guess.

sussane is partially correct. you will be able to quit claim your interest in the property to your former wife, and she will have to refinance. however, what sussane didn't mention is that you want these two actions to be simultaneous, so as to protect both of you, particularly you as you transfer your ownership.
