new deed?

I am selling a piece of property to my mother and need to transfer the deed to her name. I contacted the county clerk's office of Montgomery County and was told to take the deed to a title company and have a new deed created before bringing it all to the county clerk. Does this make sense? Can I not just do a Warranty Deed?
You can probably get one online or at the courthouse or a title company. Anyone can file the deed, it is just a matter of taking it to the court house and paying the fees.

Hi chaosmom,

You can contact a real estate attorney and he will draft the warranty deed which you need to fill out in order to transfer the property to your mother. Once the deed is filled out and notarized, you can record it at the county clerk's office.

Theoretically, title insurance should kick in to cover any title defects not protected under the warranty deed. However, just as a warranty deed may contain exceptions to coverage, so to can a title insurance policy contains exceptions to coverage. :idea:
