Husband died - wife is not on mortgage but is on title

My husband died 1 year ago without a will. After his death I was served with foreclosure papers and at that time I found out I was not on the mortgage loan and therefore could not access any information about the loan. I am listed as a joint tennant with my deceased husband on title. Bank of America has told me that this information is not sufficient and I will need to provide them with documentation from the court appointing me as the Administrator of the Esate before they will release any information to me. Is this accurate/legal? Shouldn't I have legal access to loan information as the property owner?
Since your name is not in the mortgage loan, you can not access information about the loan.

Hi flower,

As far as I know, Bank of America is correct in saying so. You're just the owner of the property and not the mortgage borrower. You should contact an attorney and take his opinion in this matter. He will let you know as to how you can get the administratorship of your deceased husband.
